The German Battery Law Implementation Act (Batterierecht-Durchführungsgesetz) is coming
On September 11, 2025, the German Battery Law Adaptation Act (Batterierecht-Anpassungsgesetz) was passed by the Bundestag in a version previously amended by the Environment Committee (Umweltausschuss). Here is the most important information about the new act.
What is the function of the Adaptation Act?
Regulation (EU) 2023/1542 of July 12, 2023, on batteries and waste batteries (EU Battery Regulation) provides for a number of opening clauses for national legislators. At the same time, it contains specific regulatory mandates addressed to the member states. In response to this need for adaptation, the Battery Law Adaptation Act has been in the planning and preparation stage in Germany for some time.
What is the main subject of the Adaptation Act?
The main subject of the Act is the creation of a new national Battery Law Implementation Act (Batterierecht-Durchführungsgesetz, BattDG). It will replace the existing German Battery Act (Batteriegesetz, BattG).
What areas does the new BattDG regulate?
In particular, the law contains regulations on waste management and extended producer responsibility. New provisions include the obligation to set up collective collection systems for all categories of batteries and to provide security deposits.
What action needs to be taken by companies who supply batteries on the EU market?
The provisions of the Batt-EU-AnpG and BattDG will apply in addition to the provisions of the EU Battery Regulation (which are already largely in force!) and primarily (but not exclusively) affect battery producers. Companies that supply batteries to the EU market should determine their role or roles (e.g., producer, importer, manufacturer, distributor?) and, based on their role(s), identify and implement their corresponding obligations.
