EUDR postponement: What happened?
Today (23 September 2025), EU Environment Commissioner Jessika Roswall announced in a letter to the Chair of the European Parliament's Committee on the Environment that the Commission is considering a further postponement of the date of application of the EU Deforestation Regulation (EU) 2023/1115 (EUDR). The letter cites as the reason for the potential postponement that the EUDR Information System will probably not be technically capable of handling the expected volume of user operations by the current EUDR application date (30 December 2025). What are the consequences of the EU Commissioner's letter?
Legally, the letter has no consequences; it is merely a declaration of intent on the part of the Commission. The EUDR as currently in force remains applicable. The (predominant) date of application of the EUDR on 30 December 2025, also remains applicable at present.
However, the letter indicates that the Commission is seriously considering postponing the date of application of the EUDR. Last year, the Commission already initiated a postponement of its date of application by one year. At that time, there was a gap of approximately two months between the Commission's proposal for a Regulation to amend the date of application and the adoption of the amending Regulation by the Parliament and the Council of the European Union. Should the Commission decide to initiate another postponement of the date of application of the Regulation, it is likely that it will present a proposal for a new amending Regulation soon. In view of the imminent start of application of the EUDR, it can be assumed that the institutions involved in the legislative process would have an interest in the swift adoption of the amendment.
What would be the consequences of postponing the start of application of the EUDR by one year?
As no legislative proposal for an amendment to the EUDR has yet been presented, the exact content and structure of a potential postponement is not yet clear. Assuming that the date of application of the EUDR is postponed again by one year, as was already the case in 2024, the EUDR would then apply from 30 December 2026 for most undertakings. It can be assumed that the date of application for small and micro-undertakings would be postponed to 30 June 2027, in this case.
What is the future of the EUDR?
It is not yet clear whether the EUDR will undergo any changes in the near future, and if so, what those changes will be. However, on September 10, 2025, the Call for Evidence on a legislative package planned by the Commission to simplify EU environmental legislation (the so called Environmental Omnibus) ended. It is rumored that the EUDR may also undergo changes as part of the legislative package.
