Product safety law

Product safety law is characterised by the harmonisation of product-related requirements at European level.

In addition to or instead of general product safety law, which is regulated in Germany in the ProdSG and formally in the Market Surveillance Act (or the EU Market Surveillance Regulation), more specific, so-called sectoral harmonisation acts often apply. These include, for example, the RoHS Directive (implemented in Germany by the ElektroStoffV), the Low Voltage Directive (implemented in Germany by the 1st ProdSV), the Machinery Directive (implemented in Germany by the 9th ProdSV), the Radio Equipment Directive (implemented in Germany by the FuAG), the EMC Directive (implemented in Germany by the EMVG), the Toy Safety Directive (implemented in Germany by the 6th ProdSV) and the Toy Safety Directive (implemented in Germany by the 6th ProdSV), the EU Medical Devices Regulation, the EU Construction Products Regulation, the EU Cybersecurity Regulation and the EU Gas Appliances Regulation.

We support manufacturers, importers, distributors and trade associations in the electrical and electronics, mechanical engineering, automotive, packaging, textile and fashion, medical devices and consumer products industries in the legally compliant design and market launch of new products (e.g. CE marking, conformity assessment, preparation of technical documentation, contact with notified bodies). Our work includes legal disputes with market surveillance authorities and conducting competition law proceedings. Our long-standing clients also include a large number of online retailers and marketplaces, which are also subject to ever-increasing product law regulations. We support companies in setting up product compliance structures.
