Real estate industry & operator responsibility
The real estate industry is facing major challenges. Affordable housing must be created despite ever-increasing regulatory requirements for energy efficiency, the use of renewable energies and low-pollutant construction products, fire protection and accessibility.
At the same time, politicians have long recognised the building stock as essential for achieving climate targets. The Taxonomy Regulation and sustainability reporting also confront property owners with a host of new requirements that have considerable economic implications. In addition, the requirements for the operation and demolition of buildings are constantly increasing. The maintenance and servicing of technical systems, the fulfilment of traffic safety obligations, the handling of building pollutants, in particular asbestos, and the requirements of the Drinking Water Ordinance with regard to Legionella bacteria also require a clear allocation of operator responsibility within companies.
Large housing associations, state-owned real estate companies and renowned project developers value our special expertise in these areas, as do the real estate departments of numerous DAX-listed companies. We advise the real estate industry on the entire spectrum of public law and organisational law issues. Our focus on environmental, planning and product law also benefits our clients in areas such as redevelopment, land recycling and contaminated site management, the interfaces between building planning law, accident prevention law and immission control law, and questions relating to the disposal of hazardous and non-hazardous construction waste.
