When it comes to the details, questions often remain unanswered. This is illustrated by the Lower Saxony Higher Administrative Court in a product law ruling from 2021, in which it notes that the subsequent, extensive official supplementation of authorisation bases is due to the constantly growing and increasingly uncoordinated web of national and European regulations. Environmental law is also largely affected by this finding. The multitude of regulations, the impractical regulation of complex technical issues and the intertwining and, in some cases, open contradictions between areas of regulation pose considerable challenges for the legal practitioners concerned.

Companies must rise to this challenge, because without comprehensive knowledge of the applicable legal basis, compliance is impossible from the outset.
