Accreditation law
The accreditation of private bodies by an accreditation authority enables monitoring and certification activities to be outsourced to private bodies.
Accreditation is usually a prerequisite for the notification or approval of private bodies.
Accreditation law is regulated in particular in Regulation (EC) No 765/2008 (the Accreditation Regulation) and the Accreditation Body Act (AkkStelleG). As part of the accreditation procedure, the accreditation body assesses the competence of private bodies on the basis of standards and other regulations. Special requirements may also arise from laws, regulations or other rules (e.g. requirements for drinking water testing bodies under the German Drinking Water Ordinance (TrinkwV), requirements for notified bodies under the EU Construction Products Regulation, etc.).
It is not uncommon for differences of opinion to arise between private bodies and the accreditation body during the procedure. We guide private bodies through the accreditation procedure and represent their interests in and out of court. We also provide support in implementing normative requirements, such as legally enforceable agreements with customers or subcontractors.
